Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) are a binding agreement between you (“User”) and the owner of BallisticsToolkit.com (“I,” “me,” or “the maintainer”).

By accessing or using Ballistics Toolkit (the “Services”), you acknowledge that you have read, understood, and agree to these Terms.

If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. Description and Purpose of the Services

Ballistics Toolkit is a free, static, non‑commercial, and educational/informational website that provides various tools and simulations related to external ballistics.

This includes (but is not limited to) trajectory calculators, load comparison tools, statistical simulations, and interactive shooting simulators.

All models, outputs, graphics, and simulations produced by the Services are theoretical and are not validated for real-world decision-making. The Services are designed for learning, experimentation, and recreational simulation, not operational use.

⚠️ 3. Safety, Real-World Use, and Accuracy Disclaimers

3.1 Real-World Use

Some users may choose to apply ballistic outputs from the Services in real-world shooting. If you do so:

3.2 Firearm Safety

BallisticsToolkit.com does NOT provide safety-validated firing data, verified dope, or guidance on safe firearm configurations.

You must not use the Services to determine safe firing solutions, maximum or minimum charges, dangerous or safe conditions, pressure limits, stability margins, or any internal ballistics behavior.

Firearm use is inherently dangerous. Always follow manufacturer instructions and standard firearm safety rules.

3.3 Reloading / Handloading Warning

The Services model external ballistics only. They do not calculate pressure, powder behavior, burn rate, or any internal ballistics properties.

The Services must not be used to create, derive, or validate load data. Always rely on published load data from component or powder manufacturers.

3.4 Modeling and Accuracy Limitations

All trajectories, wind effects, drift values, stability estimates, simulations, animations, statistical results, and visual outputs are approximations subject to factors such as:

No guarantee of correctness, completeness, or accuracy is made.

3.5 Not Professional Advice

Nothing provided by the Services constitutes ballistic engineering advice, gunsmithing guidance, legal advice, safety recommendations, or a load development methodology.

No Duty of Care / No Professional Relationship: Use of the Services does not create any professional, fiduciary, or special relationship between you and the maintainer. The maintainer owes no duty of care regarding your decisions or actions.

3.6 Use at Your Own Risk

You assume all risks associated with using the Services, whether for learning, simulation, experimentation, or any real-world application.

4. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. The Services are not intended for minors. By using the Services, you represent and warrant that you meet this age requirement.

5. Acceptable Use

You agree to use the Services only for lawful purposes. You may not:

6. User Feedback

Ballistics Toolkit does not provide user‑generated content services (for example, forums or comments). If you choose to submit feedback or suggestions (for example through email or GitHub issues), you grant the maintainer a non‑exclusive, perpetual, irrevocable, royalty‑free license to use that feedback for any purpose without compensation.

7. Intellectual Property

Unless otherwise noted, all content, design, and software on Ballistics Toolkit are owned by the maintainer and/or licensors. Open‑source components are governed by the licenses posted in the GitHub repository.

Except as stated in those licenses, all rights are reserved. You may not remove copyright notices or attribution.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.

No warranty is made regarding the accuracy, reliability, or completeness of any calculations, simulations, or outputs, or regarding suitability for any real-world purpose, uninterrupted or error‑free operation, non‑infringement, merchantability, or fitness for a particular purpose.

To the extent permitted by law, any implied warranties are expressly disclaimed.

9. Bugs, Errors, and Technical Limitations

You acknowledge that the Services may contain bugs or coding errors, incorrect formulas or logic, numerical instability, outdated or incomplete ballistic data, rendering artifacts, or simulation inaccuracies.

There is no guarantee that any output is correct, that errors will be corrected, that data is complete or current, or that real‑world results will match the Services.

10. Limitation of Liability

To the fullest extent permitted by law, the maintainer is not liable for any personal injury or death, property damage, direct or indirect damages, incidental or consequential damages, loss of data, profits, or opportunities, or for decisions made using any calculation, simulation, or output from the Services.

Because the Services are free and non‑commercial, the site owner's total liability in any dispute shall not exceed US $50 (or the minimum amount permitted by law).

11. Indemnification

You agree to indemnify and hold harmless the Ballistics Toolkit maintainer from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use or misuse of the Services, your application of results in real-world contexts, your violation of these Terms, or your infringement of any rights of a third party.

12. Governing Law

These Terms are governed by the laws of the jurisdiction where the site owner resides, without regard to conflict‑of‑law rules.

Venue: Except where prohibited by law, you agree that any disputes arising under these Terms shall be brought exclusively in the state or federal courts located in the site owner’s jurisdiction of residence, and you consent to personal jurisdiction and venue in those courts.

As a small, personal project, there is no formal arbitration program.

13. Modifications

The maintainer may modify, update, or discontinue the Services at any time without prior notice.

These Terms may be updated periodically. Material changes will be posted on this page with a new “Last updated” date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

14. Contact

If you have questions about these Terms, please contact the maintainer via the Contact page on the website.

15. Survival

Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, governing law, and any other provisions that by their nature should survive termination shall remain in effect after your relationship with Ballistics Toolkit ends.
